Good faith for a golden bunny?

Bunnies go with Easter and not with Christmas… however in the run up to the festive season, the well-known chocolate maker Lindt is facing to be found guilty of having acquired its trade mark to its chocolate bunny wrapped in golden foil in bad faith if it cannot prove that it did not know that its Austrian neighbours were already using the same rabbit. We will know only next Christmas.   The preliminary ruling can be seen by following the lead link.
